DECLARATION OF INDEPENDENCE
December 6, 1997
1. The Dayton Agreement is in violation of the Constitution of the
Republic of Bosnia and Herzegovina and this is why a legal suit
against the Dayton Agreement has been filed with the Supreme Court
(Constitutional Court) of the Republic of Bosnia-Herzegovina in
Sarajevo. Only the Constitutional Court of the Republic of Bosnia
and Herzegovina has the constitutional (legal) authority to decide on
the constitutionality of Dayton Agreement. Refugees and we the
people of the Republic of Bosnia and Herzegovina do not recognize any
institution which has resulted and will result from the Dayton
Agreement including the "Dayton Constitution" and the "Dayton
Constitutional Court". The "Dayton Constitutional Court" is not
authorized to make any decision about the legality of the "Dayton
Agreement".
2. The "Dayton Constitution" was negotiated between enemies of our
homeland against the interests of the Bosnian people and our country.
The "Dayton Constitution" was not adapted according to procedures
required by the Constitution of the Republic of Bosnia-Herzegovina
and as such is not valid.
3. The "Dayton Constitution" annuls the freely expressed will of the
citizens of the Republic of Bosnia-Herzegovina at the referendum on
Bosnian independence held on March 1, 1992. The "Dayton
Constitution" artificially creates new "entities", the "Federation of
Bosnia-Herzegovina" and the "Serb Republic" on the territory of
the Republic of Bosnia-Herzegovina.
4. Even if the constitutionality of the Dayton Agreement were
conceded, up to now, many provisions of the Dayton Agreement were not
complied with, such as a free return of refugees to their homes and,
therefore, it is obvious that the Dayton Agreement has annulled itself.
5. For all the above reasons, we, the people of the Republic of
Bosnia-Herzegovina do not recognize the Dayton Agreement. We,
the Bosnian people, pursuant to the Constitution of the Republic of
Bosnia-Herzegovina and the results of the referendum for
independence have the right to liberate our homeland from both
aggressor countries, Croatia and Yugoslavia, and to implement the
power of the Constitution of the Republic of Bosnia-Herzegovina
on every square millimeter of our homeland.
6. General elections of September 1996 and local elections of
September 1997 were held according to the "Dayton Constitution" and
are not in compliance with the Constitution of the Republic of
Bosnia-Herzegovina. The elections were a farce and an exercise in
absurdity. Both elections had a major goal of putting on a
"democratic face" to the illegitimate change of the Constitution of
the Republic of Bosnia-Herzegovina, and thus "legitimize" the
situation created by genocide, and aggression.
7. As already mentioned, even the conditions required by the Dayton
Agreement were not met in those elections. The refugees were denied
the right to return to their homes and to take part in the elections
at their home towns. Even according to the provisions of the Dayton
Agreement elections were not valid.
8. Because of all the foregoing facts, we, the people of the Republic
of Bosnia-Herzegovina do not recognize these elections and any future
elections until the entire territory of the Republic of
Bosnia-Herzegovina is liberated and the legitimate Constitution is
implemented in the entire territory of our homeland.
